Just because a worker works in a plant where there are always added risks of an explosion does not mean that the company can skimp on proper safety measures. In fact, companies that do know of the added risk due to what they manufacture or what materials are being worked with should do the exact opposite and have increased safety measures to ensure their workers are as safe as possible under dangerous conditions. This, unfortunately, is not always the case and many employees suffer explosion related injuries. The team of expert explosion accident attorneys at the Law Offices of Gilbert R. Hoy, Jr. and Affiliates have been successful in recovering millions of dollars in damages for our Massachusetts clients.
A Spokane, Washington aerospace company will pay one of the largest penalties ever to the Department of Labor & Industries and will continue to be listed as a “severe violator” as part of an appeal settlement over safety and health violations at the company’s Newport, Washington plant. Seventeen workers were injured in an explosion at the Zodiac Cabin & Structures Support LLC plant in July 2015. An investigation completed in January 2016 found 17 willful violations, one for each worker who was injured and hospitalized. The company was also cited for 21 serious violations.
The final willful violation affirms that the company used defective equipment and didn’t ensure that safe procedures were used when processing flammable materials in its industrial curing oven, as advised in a consulting engineer’s report. This directly led to the explosion. Along with upholding the severity level of each violation, the settlement requires Zodiac to pay a final penalty of $500,000 related to one willful violation affecting 17 workers, and the serious violations. The company was originally fined more than $1.3 million.
